M/S Pegasus Inland Container Depot (P.) Ltd., Survey No. 981, Pithampur- Indore Airport Road, Village Dhannad, Post Betma. Indore-453001 (M.P.) are the custodian of ICD Dhannad. Vide letter reference No. ICDD/CUS/Cost Recovery/2 dated 2.1.2015 they have applied for exemption/waiver from payment of Cost Recovery Charges of Customs staff to the Commissioner of Central Excise, Indore, who vide his letter F. No. I(Gen) 19- 45/2005/Cus/T/Pt. II/6746 dated 22.6.2015, has forwarded the said application after verification to this office in terms of the CBEC's Circular no. 13/2009-Cus dated 23.3.2009 issued vide F. No. 450/55/2008-cus-1V CBECs instructions issued vide F.NO. 434/17/2004-cus IV dated 12.9.2005. 2. In terms of the Board's Circular no. 13/2009-Cus dated 23.3.2009, and instructions issued vide F. No. 434/17/2004-Cus IV dated 12.09.2005 vide F.No. A/11018/02/2011-Ad IV pt dated 26.05.2011, eligible ICDs which fulfill the laid down criterion may be considered for exemption/ waiver from payment Of cost recovery charges. Further CBEC vide F. No. 8/B/28/HRD(EMC)/CRB/2014 pt dated 3.11.2015, as one-time measure, has authorized the Chief Commissioner to exempt Cost Recovery Charges ('CRC') for eligible facilities. 4. The benchmark performance parameters prescribed for waiver of const recovery charges vide the Board's instructions issued vide F. No. 434/17/2004- Cus IV dated 12.9.2005 stipulates that ICD/CFS should be in operation for two consecutive years with following benchmarks met for past two years:- (a) No. of containers handled by ICD : 7200 TEUs per annum (b) No. of containers by CFS: 7200 TEUs per annum (c) No. of BE or SB processed by ICDs/CFS : 7200 per annum for ICD 1200 for CFS 5. M/S Pegasus Inland Container Depot (P) Ltd., (ICD Dhannad) have fulfilled the benchmark by remaining in operation for consecutive two years and have handled 12629 16770 containers besides having filed 7648 8858 documents in past two years i.e. 2013 and 2014, respectively. Hence, the performance of the ICD verified by the jurisdictional officer is found to be above the said benchmark prescribed. Hence, they are eligible for the waiver of the CRC. 6. Accordingly, M/S Pegasus Inland Container Depot (P.) Ltd. Survey No. 981, Pithampur-lndore Airport Road, Village Dhannad, Post Betma, Indore-453001 (M. P.)
