MISC.779 /2016-BONDS (AIR) DATED: 12.08.2016 PUBLIC NOTICE NO. 22/2016 Subject: Review of Clearance of goods to 100% EOUs, STPIs, EHTPs etc - Removal of mandatory warehousing requirement of EOUs, STPIs, EHTPs etc - Revised Guidelines - Regarding. Attention of all the Importers, Customs Brokers and the Member of the Trade is invited that CBEC has issued a Notification No.44/2016 dated 29th July 2016 which amended the principal Notification No. 52/2003-Customs dated 31.03.2003. Further attention is drawn to the Circular No.35/2016 dated 29th July, 2016, wherein, the Board has decided that the subject units (EOUs, STPIs, EHTPs etc) need not obtain Licence as warehouses under Customs Act, 1962, with effect from 13th August, 2016. The units which are having warehousing licence already shall stand delicensed with effect from 13.08.2016. However, they shall continue to adhere to the provisions of Notification No. 52/2003-Customs dated 31.03.2003, FTP, KBP and other applicable Notifications as stated in the Para 4 of the Circular No. 35/2016- Customs dated 29.07.2016. 2. The procedure in clearing of goods imported for above said units as per the new Circular is as follows: Para 6: In view of the warehousing procedures having been dispensed with for these units, the system of sending re-warehousing certificates to the Customs Station of import shall also stand dispensed w.e.f. 13th August, 2016. Para 7: In place of the re-warehousing certificate procedure, the following is prescribed: (i) The Units shall continue to obtain/ furnish a Procurement Certificate at the Customs Stations at the time of import or pre-authenticated Procurement Certificates, as applicable to them; (ii) Upon receipt of goods in the unit, a copy of the relevant Bill of Entry shall be provided to the jurisdictional office; (iii) The jurisdictional office shall reconcile the imports with Procurement Certificates. 3. In view of the above, forwarding letter to the jurisdictional Central Excise authorities intimating the dispatch details of imported goods and subsequent submission of re-warehousing Certificates to Bond Section for closure of Transfer Bond shall stand dispensed with, in respect of Bills of Entry to be filed from 13th August, 2016 for these units. As a consequence, Gate Officers/ Preventive officers can permit clearances of such imports of these units as of the normal consignments after granting OOC by the proper officers. (K. RAGHU N.
