No. 263/39/91-CX.8] Government of India Ministry of Finance (Department of Revenue) Central Board of Excise Customs, New Delhi Subject : Clearance of inputs under Rule 57F(1A) waiver of requirement of filing CL/PL - Instructions regarding. I am directed to draw your attention to the amendment of Rule 57F carried out vide Notification No. 4/92-C.E. (N.T.), dated 1-3-1992 whereby sub-rule (1A) has been inserted in the Rule. This sub-rule provides that the inputs in respect of which restricted Modvat credit has been avalied under Rule 57A may be removed subject to prior permission of Collector of Central Excise from the factory for home consumption on payment of duty of excise equivalent to the credit availed on such inputs. 2. Pursuant to this amendment the Board has decided that there should be no need to file classification list or a price list in such cases. Such goods can be allowed clearance on a gate pass with a cross reference to the earlier entry in RG-23A, Pt. II vide which Modvat credit has been taken so that it can be ensured that the exact amount of credit taken by the assesses at the time of bringing the goods into the factory has been reversed by him. 3. Trade and field formations may be informed suitably. 4. Receipt of this circular may please be acknowledged.
