Kind attention of all the stakeholders is invited to the Plastic Waste Management Rules, 2016, which have been amended to introduce Schedule II to said Rules, vide Plastic Waste Management (Amendment) Rules, 2022. Accordingly, Extended Producer Responsibilities on Producers, Importers and Brand Owners have been made applicable to both pre-consumer and post-consumer plastic packaging waste. 2. In this regard, Instruction No. 14/2023-Customs dated 17.04.2023 issued by the CBIC is brought in the knowledge of all the stakeholders. The said Instruction has been issued in consultation with CPCB and clarifies that clearance of import consignments of plastic packaging products or products with plastic packaging or carry bags or multi layered packaging or plastic sheets or like can be considered based on the proof of submission of application for registration on the Centralized EPR portal. 3. In light of said instructions, the following procedure shall be followed for clearance of the Bills of Entry filed for import of plastic packaging products or products with plastic packaging or carry bags or multi layered packaging or plastic sheets or like:- (i) Importers are required to upload the EPR registration in e-Sanchit at the time of filing of the Bills of Entry to avoid any query on this issue. (ii) Where EPR registration is not available at the time of filing of Bill of Entry, though the Importer had applied for the same on the CPCB portal, the Importer is required to upload the Application status in e-Sanchit. On submission of proof of application, goods shall not be kept on hold by the Customs Authorities and the consignment shall be released. (iii) The officer giving Out of Charge shall check real time status of said application on https://eprplastic.cpcb.gov.in/ and Deputy Commissioner/ Assistant Commissioner of concerned Docks cluster shall maintain the record of such consignments in the format annexed to the Standing Order No. 11/2023 dated 25.05.2023, to enable monitoring of such Importer having eventually obtained the EPR registration or otherwise. (iv) Where the importer has not filed an EPR application on the CPCB portal at the time of filing of Bill of Entry and subsequently files the said application, i.e. after the filing of Bill of Entry, such cases will also be dealt in the same manner as mentioned in points no. (ii) and (iii) above. 4. Deputy/Assistant Commissioner of concerned Docks cluster shall immediately bring the fact of rejection of application by CPCB or non-issue of registration, and in any case not later than 6 months of clearance (grant of Out of Charge) of the goods, to the notice of Deputy / Assistant Commissioner in-charge of concerned Appraising Group. Required statutory action against such consignment and the Importer shall be taken by the concerned Appraising Group. 5. This issues with the approval of the Chief Commissioner of Customs JNCH.
