I am directed to invite your attention to Point 10.6 of the monthly Modvat meeting held at Bombay on 22-4-1989 regarding admissibility of Modvat credit on tool kits and jack assy supplied along with motor vehicles. The matter has been examined by the Board. It has been decided that Modvat credit of duties paid on tool kits and jack assembly would be admissible provided such tool kits/jack assembly are supplied along with motor vehicles and value is included in the assessable value of the motor vehicles. Board's instructions issued vide F. No. 267/82/88-CX.8, dated 3-10-1988 stand superseded. This also disposes of Point No. 14 of the East Zone Tariff cum-general Conference held at Calcutta on 27th and 28th January, 1989. The above instructions may be brought to the notice of the field formations. Receipt of this letter may please be acknowledged.
