DIN No. 20231172MP000021792E Date: 31-10-2023 PUBLIC NOTICE No. 19/2023-AP ACC BLR Air Public Notice No.19/2023 dated 31.10.2023 M/s FedEx Express Transportation and Supply Chain Services Ind. Pvt. Ltd. as custodian in respect their own courier consignments is extended for a period of ten years i.e upto 30.10.203. In exercise of the powers conferred under Section 45(1) and Section 141(2) of the Customs Act, 1962, read with Handling of Cargo in Customs Area Regulations, 2009 as amended, I, KAJAL SINGH, Principal Commissioner of Customs, Air Customs Commissionerate, Bengaluru, hereby appoint M/s FedEx Express Transportation and Supply Chain Services (India) Private Limited , as custodian in respect of their own Courier consignments that are imported or exported or transshipped through 'FedEx Express Courier facilities' at Plot no C-19, Express Cargo Terminal, Survey no 90,180,181,182,183,197, Kempegowda International Airport, Bengaluru until they are either cleared for home consumption or exported or warehoused or transshipped in accordance with the provisions of the Customs Act, 1962. The Custodianship initially granted for a period of 2 year vide Public Notice No. 32/2021-AP ACC BLR dated 02.11.2021 has been reviewed and is further extended for a period of ten years from the date of issue of this Public Notice i.e., upto 30.10.2033 and subject to the following conditions: 1) The said Custodian of the goods meant for import, export and transshipment would be required to comply with the provisions of Section 45(2) of the Customs Act, 1962 and other relevant Provisions/ Sections of the Customs Act, 1962 and Rules and regulations made there under as well as the Circulars/instructions issued from time to time in this regard. 2) The Custodian shall be responsible for the proper receipt, handling, storage and shall be accountable for the loss of goods either imported or those meant for export or transshipment after their receipt and before their intended purpose. The Custodian shall maintain proper record of all such goods including those to be disposed of after the expiry of 30 days of the arrival or otherwise. 3) If any imported/export/transshipment goods are pilfered or lost after unloading in the Customs area and while in the custody of the Custodian, then the Custodian shall be liable to pay duty on such pilfered / lost goods in terms of provisions of Section 45(3) of the Customs Act, 1962. 4) The imported/export/transshipment goods, which are not cleared for their intended purpose within 30 days or within the extended period as the proper officers may allow, or in case of relinquishment of title by the importer in terms of Section 23(2) of the Customs Act, 1962, such goods shall be dealt with in accordance with Customs Act 1962 and Regulations made there under. 5) The Custodian shall provide safe, secure and spacious place for loading/unloading/ storage of the cargo. The infrastructure for loading/unloading and storage operations should be designed to handle projected traffic of the Courier Consignments. 6) The Custodian shall provide sufficient modern handling equipment in operational condition for handling of the courier consignments in the notified area. 7) The Custodian shall provide proper office space for Customs Officers for performing the duty as mutually agreed. No alteration of the plan in the accommodation, boundary wall and building etc. shall be made without the concurrence of the Principal Commissioner of Customs, Bengaluru. The Custodian shall provide office space for Customs in Examination Area also. 8) Free suitable transport facility shall be provided by the custodian for the Customs staff posted at their approved premises. 9) The Custodian shall make adequate arrangements for sanitary facility, water supply and other facilities including the canteen facility for the Customs staff posted at their approved premises. 10) The custodian would also be held responsible for duty and other penalties leviable for the goods lost during the transshipment from the said Customs area to the gateway port / other Customs area. 11) Entire notified area shall be insured by the Custodian. 12) For the proper discharge of duties, the Custodian shall execute a bond in terms of their turnover projection for the sufficient amount supported by a bank guarantee or a Govt. bond or cash deposit equivalent to 10% of the bond amount in terms of the prevailing instructions. 13) Security of the approved premises shall be the responsibility of the Custodian subject to the prior approval of the Principal Commissioner of Customs. The cost of the security shall be borne by the Custodian. 14) Custodian shall not charge any rent/demurrage for the goods detained by the Customs Department / Investigating agencies under the Customs Act 1962, for the time being in force. 15) In case the Custodian intends to sublet any of the functions inside the Customs area or connected with the Customs area, the same shall be done with the approval of the Principal Commissioner of Customs and the Custodian shall remain responsible for all omissions and commissions of such agency. 16) Uninterrupted thoroughfare shall be provided to the Customs officials in the entire premises of customs area. 17) Custodian shall be responsible for any improper removal of imported/exported goods and shall be liable to pay appropriate duties, cess, etc on such improper removals. 18) The Custodian is required to provide for increase in space and in infrastructure as and when requisitioned by the Customs. 19) In the event of the Custodian found not being able to achieve and sustain expected service/delivery standards and is not able to improve even after being informed by the Principal Commissioner of Customs, Bengaluru- the notifying authority, the Principal Commissioner of Customs reserves the right to de-notify or relocate the processing/handling activities to the other Custodian. 20) The appointment is subject to conditions specified in the undertaking executed by M/s FedEx Express Transportation and Supply Chain Services (India) Pvt Ltd. before the Principal Commissioner of Customs, Airport and Air Cargo Commissionerate, Bengaluru.
