EPCG AUTHORISATION OFFICE OF THE ZONAL JT. DIRECTOR GENERAL OF FOREIGN TRADE (CLA), 'A' WING, I.P. BHAWAN, INDRAPRASTHA ESTATE, NEW DELHI-2. Trade Notice No. 5 Date:- 09/10/09 1. It is observed that applicants, filing application for EPCG authorizations under Zero Duty / 3% Duty, are submitting declarations / undertakings given at the end of ANF5A in a very routine manner. Declarations are being signed without checking whether a particular declaration is applicable to the applicant or not. List of declarations/ undertakings, is very exhaustive covering provisions related to the EPCG Scheme i.e. whether the application is under Zero Duty or 3% Duty; or whether the application is for import of spares; or whether import is made by SSI sector / retail sector etc. This practice is continuing in spite of clear instruction at the end that 'not applicable clauses need to be struck out'. Similar is the position with regard to Chartered Engineers and Chartered Accountants who are not deleting those portions in their respective certificates, which are not applicable to a particular application. 2. So far, this office has been accepting such applications without raising any deficiency in this regard. 3. However, the matter has been reviewed and it has been decided that henceforth all applicants for EPCG authorization must submit only those declarations/ undertakings which are applicable to that particular application. All other declarations / undertakings which are not applicable must be deleted or properly crossed in the application. 4. Similarly, applicants must ensure that Chartered Engineer and Chartered Accountants delete non-applicable portions in their respective Certificates. In the event of not doing so, deficiency would be raised by this office. Trade and industry are requested to ensure compliance of these guidelines.
