Follow up of cases before courts. - Income Tax - 1652/CBDTExtract INSTRUCTION NO. 1652/CBDT Dated: October 10, 1985 In the case of CIT(Central-1) Delhi Vs. M/s. R.B. Multanimal Sons I.T. Ref. No. 128 of 1979 the Allahabad High Court returned the Department's reference application unanswered. The Court observed that after filing of the application on 13 occasions, time for filing paper books varying from one month, six months and two months was granted. Despite such indulgence being granted by the court, the paper book was not filed for a period of less than 3 years. After a lapse of more than 5 months an application for restoration was filed on behalf of the Department. The standing counsel obtained one month's time to file a supplementary affidavit annexing thereto copies of all letters sent by him to the departmental authorities for taking steps for preparation of paper books. The supplementary affidavit was not filed within the extended time granted. The reports received from Commissioner and the standing counsel show that this had happened on account of communication gap between them. The letters were not sent or replied to in time nor a watch was kept on feed back. You may please instruct all the officers in your charge to keep watch on the progress of the cases before the courts for timely action. You may discuss with the officers working in your judicial branch to ensure that there is no such communication gap in these matters in your charge.
