Quick disposal of cases-Adjournments. - Income Tax - 1677/CBDTExtract INSTRUCTION NO. 1677/CBDT Dated: December 23, 1985 I am directed to forward the enclosed copy of D.O. letter F.No. 21(17)/85-Judl. dated 26-11-85 from the Secretary Ministry of Law Justice for information and necessary action. A copy of this letter may be endorsed to all the Standing Counsels and Authorised Representatives of the Department for compliance. SECRETARY Government of India Ministry of Law Justice (Department of Legal Affairs.) P.K.Kartha D.O. No. F.21 (17)/85-Judl. Shastri Bhawan New Delhi, the 26th Nov., 1985 Dear Shri Pande, As you may be aware, the Department of Legal Affairs, Ministry of Law and Justice, is making all out efforts to ensure early hearing and quicker disposal of various cases, especially important cases involving either high financial stakes or a substantial question of law which may have wider repercussions, pending before the Supreme Court and various High Courts in India. 2. It has, however, come to our notice that frequent adjournments are being sought either because of the non-availability of a particular Counsel or due to other reasons at the request to the administrative Ministry/Department concerned. Such adjournments defeat the very objective of quicker disposal of cases. 3. In one such instance, the Minister of State for Law has observed that the requests for adjournments should be made only in very exceptional cases, and not merely because some particular Counsel was not available or due to certain other similar reason. It will, therefore, be appreciated if such exceptional cases, where adjournments are sought are brought to the notice of our Minister. With kind regards, Yours sincerely, Sd/- (P.K.Kartha) Shri V.C.Pande Secretary (Rev.) Ministry of Finance Jeevan Deep Building Parliament Street New Delhi.
