Appraisal report in cases of search. - Income Tax - 1748/CBDT

INSTRUCTION NO. 1748/CBDT Dated: February 11, 1987 Vide Instruction No. 1621 dated 4th June, 1985 issued from F.No. 286/112/85-IT(Inv. II), the Board had desired that a copy of the appraisal report be sent within three days of the completion of the search in all cases. The Search Seizure Manual, issued in 1985, had mentioned that a preliminary report should be sent within a week of the conclusion of the search (para 4.20) and in cases of substantial concealment a detailed appraisal report within one month from the date of the search (para 4.22). The latter report was also to be endorsed to the member (investigation) in the C.B.D.T. 2. It has now been decided that a copy of the appraisal report should be endorsed to the Board, only in search cases of (a) Large Industrial Houses or (b) Where the seizure of assets exceeds Rs. 50 lakhs. 3. The time limit for sending the preliminary appraisal report in such cases to the Board has also been extended from three days to seven days of the completion of the search. 4. All past references to sending of appraisal report to the Board made in Instruction No. 1621, Search Seizure Manual, Member (investigation's) D.O.F No. 411/16/81-IT (Inv. II) dated 28-1-1986 [para 4(2)] stand accordingly modified. 5. These revised instructions should be brought to the notice of all concerned.
