Drawback Rules - Amendments Notification No. 17/96-Cus. C.E. (N.T.) Dated 20-3-1996 In exercise of the powers conferred by section 75 of the Customs Act, 1962 (52 of 1962) and section 37 of the Central Excises and Salt Act, 1944 (1 of 1944), the Central Government hereby makes the following further amendments in the Customs and Central Excise Duties Drawback Rules, 1995, notified by the Government of India in the Ministry of Finance (Department of Revenue) notification No. 37/95-Customs and Central Excises (N.T.), dated the 26th May, 1995, namely :- 1. (1) These rules may be called the Customs and Central Excise Duties Drawback (Amendment) Rules, 1996. (2) They shall some into force on the date of their publication in the Official Gazette. 2. In rule 13 of the Customs and Central Excise Duties Drawback Rules, 1995 (hereinafter referred to as the said rules), in sub-rule (1), the existing proviso shall be substituted by the following proviso, namely :- "Provided that the aforesaid period of three months may be extended - (a) by the Assistant Commissioner of Customs by a further period of three months, and (b) by the Commissioner of Customs by a further period of nine months, On being satisfied that the exporter was prevented by sufficient cause from filing his claim within the aforesaid period of three months. 3. In rule 18 of the said rules, in sub-rule (2), in clause (c) for the words "may file his claim within a period of three months from the commencement of these rules", the words and figures "may file his claim on or before 30th June, 1996" shall be substituted.
