Amendment in the Customs notification No.7/2003-Customs, dated the 7th January, 2003 - 081/2003 - Customs -TariffExtract Amendment in the Customs notification No.7/2003-Customs, dated the 7th January, 2003 May 14, 2003 Notification No. 81/2003 - Customs WHEREAS in the matter of import of Float Glass of thickness 2mm to 12mm (both thickness inclusive) of clear as well as tinted variety (other than green glass) but not including processed glass meant for decorative, industrial or automotive purposes, falling under heading 7005 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), originating in, or exported from, the Peoples¹ Republic of China and Indonesia, the Central Government, on the basis of the preliminary findings notification No. 14/19/2002-DGAD, dated the 20th November, 2002 of the Designated Authority, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 20th November, 2002, has imposed provisional anti-dumping duty vide notification of the Government of India in the erstwhile Ministry of Finance and Company Affairs (Department of Revenue), No. 7/2003-Customs, dated the 7 th January, 2003; AND WHEREAS, the High Court of Judicature at Madras vide its order dated 13.3.2003, in the W.P. Nos. 44506 and 44507 of 2002 - Mahavir Mirror Industries Vs the Designated Authority, Directorate General of Anti-dumping and Allied Duties, Governement of India and others and in W.P. Nos. 3193 and 3194 of 2003 - Monika Exim International Ltd. Vs the Designated Authority, Directorate General of Anti-dumping and Allied Duties, Governement of India and others, has ordered that there is no merit in these writ petitions and has accordingly dismissed these writ petitions and the connected W.P.M.Ps.; NOW, therefore, in exercise of the powers conferred by sub-section (2) of section 9A of the said Customs Tariff Act, read with rules 13 and 20 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, the Central Government, hereby makes the following amendment in the notification of the Government of India, in the erstwhile Ministry of Finance and Company Affairs (Department of Revenue), No.7/2003-Customs, dated the 7 th January, 2003, namely:- In the said notification,- (i) in paragraph 1, the portion beginning with the words ³ AND WHEREAS, the High Court of Judicature at Madras² and ending with the words ³until further orders by the said Court;² shall be omitted; (ii) paragraph 3 shall be omitted.
