Medical equipments - Amendment to Notification No. 65/88-Cus. Notification No. 123/94-Cus. Dated 3-6-1994 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue) No. 65/88-Customs, dated the 1st March, 1988, namely :- 1. In the said notification, for the words "medical equipments, their accessories and spare parts", the words "the goods" shall be substituted; 2. In the Table annexed to the said notification, for part "(C) Other Medical Equipments" and the entries relating thereto, the following part and entries shall be substituted, namely :- "(C) Other Medical Equipments : 1. High powered X-Ray unit more than 50 KW with special attachments for paediatric patients, Image intensifier, T.V. System and Cut film camera 2. Automatic Electronic Blood Cell Counter 3. The following Items required by spinal patients and other categories of physically handicapped people :- (i)(a) Folding wheel chairs with detachable arms and foot rests (b) special light wheel chairs for easy handling (c) motorised wheel chairs (d) special purpose chairs for stairs climbing for tetraplegics and paraplegic workers (ii) Aids for disabled namely, folding walking frames (iii) Aids to extend reach to pick up small items (with small magnet pick up) (iv) Specialised fixtures for orthopaedic and spastic, tetraplegics for manoeuvring and providing dexterity to fingers and wrist (v) Turning beds for prevention of pressure sores (vi) Emulsion cushions for tetraplegics and working paraplegics to avoid pressure sores 125. Multichannel (more than three channels) Cardiac Monitoring System with/without Central Monitoring Unit 126. Hyperthermia Machine 127. Marlex Mesh 128. Dental X-Ray machine 129. Digital Immaging system for face X-rays 130. Orthopantom ram (O.P.G.) X-rays for Jaws 131. Jaw Surgery equipments (i) Stryker saws (ii) Special titanium and Tungston carbide drill bits (iii) Jaw Surgery instruments including special retractors, bone holders"; 3. The following provisos shall be added after the Table annexed to the said notification, namely :- "Provided that the components parts of the goods mentioned in Table above shall be exempted from so much of that portion of the duty of Customs leviable thereon under the said First Schedule, as is in excess of the amount calculated at the rate of 15% ad valorem, when imported into India for the manufacture of the said goods : Provided further that the spare parts (other than populated Printed Circuit Boards and Ball Bearings) of the goods mentioned in Table above, shall be exempted from so much of that portion of the duty of Customs leviable thereon under the said First Schedule, as is in excess of the amount calculated at the rate of 15% ad valorem, when imported into India for the maintenance of the said goods, subject to following conditions :- The importer furnishes, at the time of importation of the said spare parts, to the Assistant Collector of Customs, an underktaking to the effect that : (a) the said spare parts shall be used for the purpose specified above; (b) the importer shall within three months or such extended period as the Assistant Collector of Customs may specify in this behalf, produce necessary evidence to the satisfaction of the said Assistant Collector to the effect that the said spare parts have been used for the aforesaid purpose; (c) the importer shall pay, on demand, in the event of his failure to comply with (a) and (b) above, an amount equal to the difference between the duty leviable on such quantity of the said spare parts but for the exemption contained herein and that already paid at the time of importation".
