Exemption to aeroplane spare parts - Supersedes Notifications No. 145/77-Cus. and No. 99/81-Cus. Notification No. 190/93-Cus. Dated 28-12-1993 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), and in supersession of the notifications of the Government of India in the Ministry of Finance, Department of Revenue and Banking (Revenue Wing) or Department of Revenue, as the case may be. No. 145/77-Customs, dated the 9th July, 1977 and 99/81-Customs, dated the 1st April, 1981, except as respects things done or omitted to be done before such supersession, the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts - (a) aeroplane parts (not being rubber tyres and tubes), (b) aeroplane engines, (c) aeroplane engine parts, and (d) rubber tyres and tubes used exclusively for aeroplanes, when imported into India, from so much of that portion of the duty of customs leviable thereon, which is specified in the First Schedule to the Customs Tariff Act, 1975 (51 of 1975) (hereinafter referred to as the said Act), as is in excess of 3% ad valorem : Provided that the goods described against items (a), (b) and (c) above when imported into India as spare parts for servicing of aeroplanes, shall also be exempt from the whole of additional duty of customs leviable thereon under section 3 of the said Act.
