Amendment to Notification No. 13/81-Cus. - G.E. No. 127] Notification No. 196/90-Cus. Dated 12-6-1990 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue) No. 13/81-Customs, dated the 9th February, 1981, namely :- In the said notification; (i) in paragraph 1, - (i) in condition (5), for clause (a), the following clause shall be substituted, namely: "(a) customs duty on capital goods, material handling equipment, office equipment, captive power plants or, as the case may be, captive generating sets, on depreciated value but at the rates prevalent at the time of import; and"; (ii) after condition (9), the following condition shall be inserted, namely :- "(10) the exemption to goods mentioned against entry at Serial No. 11 of the Table below shall be available for such items and to such extent as the Central Government may in each case allow having regard to the recommendations made in this behalf by the said Board of Approvals for 100% Export Oriented Undertakings;" (iii) in the Table, after Serial No. 10 and the entry thereto, the following Serial No. and entry shall be inserted, namely :- "11. Captive power plants, including captive generating sets and their spares, fuel, lubricants and other consumables for such plants and sets as recommended by the said Board of Approvals".
