Hi, have a look at FTP 2015 & read 3.06 Ineligible categories under MEIS (xvi. Export of milk and milk products)

&

Have a look at latest MEIS appendix Appendix 3B-MEIS Schedule (Ch. 04) HS: 04051000 "Butter" has got reward under group B

Now whom we should believe FTP 2015 or MEIS appendix ?

please enlighten.

Dear Friend,

You may have to consider the Appendix since while issuing the amendment in the appendix, DGFT should have issued by way a Public Notice and in that an amendment to policy also might be made.

Better cehck for the same

First of all I would like to thank you that you replied my answer on "Sunday". Truly Hats-Off

your view point is 100% correct. I have checked in www.indiantradeportal.in by setting Japan (Group B country) for HS code: 04051000 in it 2% reward is given for group B same in MEIS appendix.

There is small issue in www.indiantradeportal.in when I set the above example

HS code for Japan was different,

it has shown 040510110
040510121
040510129
040510210
040510221
040510229

But not  04051000, so is 04051000 allowed in Japan ?? what we should write in invoice 04051000 or 040510110 or other ?

Dear Mr. Krishan,

No difference needs to be spotted in Para 3.06 & Appendix 3B of MEIS.

Have a look at DGFT Notification No. 08/2015 dated 04.06.2016, highlighted below phrase has been added to, which addresses to your concern.

(xvi) Export of milk and milk products, unless specifically notified in Appendix 3B

Also please note that even if the MEIS rate is defined in Appendix for a particular product, DGFT can issue Public Notice thus adding the product under ineligible categories in Para 3.06 and the same will prevail over Appendix.

Further ITC code has to be read as per Indian Tariff Act and MEIS Appendix has been aligned to same. You may take up with DGFT Hqrs for correction of any ITC if the same is not in aligned.
