Dear Experts,

I work as a IT Trainer. I got a enquiry for training. I quoated a amount as commercial day wise 8K + TDS.

The training was for 10 days. Now the company instead pays me 80K paid 72K and deposited 8K. I informed the client that this is a clear case of cheating. But the client didn't respond. Now I want to lodge a compaints against the entire episode to the Govt. authority and want to get back my 8k amount. I would like to fight against this injustice. Kindly suggest the very appropriate steps.

The company rightly deduct 10% of tax as TDS as your a professional. This amount will be reflect in your 26AS form that can be viewed from the Income tax department website. If your income including this income is less than the threshold limit you can get refund for ₹ 8000/-. If your income exceeds the taxable income, then you have to pay the balance tax for the sum received from the company according to your tax slab rate.

But sir, the net amount (in hand amount) company has pay to me is 80K why they paid me 72K? Why they deduct my hard earned 8K, instead they pay 8K from their pocket. That's my point.

Sir,

Your fees is ₹ 8000/-. For this amount TDS @10% is ₹ 800/-. After deducting TDS amount of ₹ 800, your client has paid ₹ 7,200/-. Therefore the payment made to you is correct.

The fees which i quoted was as

Commercials per day 8K + TDS

Then my net amount should comes 80K + 8K as a TDS.......That's what my point sir..

Sir, the concept of TDS is such that it has to be deducted from the fees amount. You said ₹ 8000/- per day plus TDS. Which means you want 8000/-. Let the client pay TDS. But while quoting your fees you should have added the TDS amount to the fees amount.

Sir, TDS deducted by your client is a credit to you. So no need to worry.
