Is there need for extension of Annual General Meeting if there is Accounts is not audited by auditor and not signing the paper to file in the roc.

You may write the facts to ROC and request for Extension of AGM Date. Please take advice from your Company Secretary.

You may seek extension from the Registrar of Companies. Three months extension could be given.

You have to file Form GNL-1 with ROC along with Board Resolution seeking extension of time, attach request letter specifyinug reasons for delay, when the accounts are likely to be approved. The maximum extension can be for 3 months.
