My GST was cancelled due to failure of non filing, to which I filed all dues and penalties and submitted hard copy to the proper officer. I was told to submit revocation form online which was not accessible to me. However the login to the GST portal was denied. I talked to the customer support of GST where they took time to look into any IT related issue but after few weeks I was directed to the proper officer again. Proper officer somehow was able to open my GST portal but the revocation section was still not working. They kept on calling be week after week to look into the matter and I kept on filing GST under the same portal which got submitted without any error or issue. However after filing for refund, the other proper officer who took power after the first for transferred told me that the refund cannot be issued as the account's status was cancelled. I narrated all episodes to him to which he talked to IT cell to know the issue with my account. Now after 6 months he told me to appeal for the revocation of the account. I did the same with the help of a GST lawyer but the appeal office denied revocation as 180 days was over (the period of the revocation using appeal) to which I was not aware of till that date nor I was told by the previous proper officer or any staff in the GST office despite several meetings related to the same. I am running a small organization and the refund has my rolling amount in it. Please tell me what are the other possibilities I have now to get the refund as its a huge amount for me which is stuck without which I would have to shutdown the firm and run away from whole world. Please file a writ petition before the High Court.
Plz don't say "run away from whole world". This world needs your help, there is always a solution for any problem.
Yes, I totally agree. File a writ petition in the High Court and do not be discouraged. I hope everything will work out very soon and that you will get your money back.
Thank you for giving me home and encouragement. I will file a writ petition in high court and will let this forum know its outcome. However just to let you know, the appeal officers again discouraged me saying 180 days are over and nothing can be done. If it could have been done, they would have gone ahead with it and even the high court will direct them to take further action to which they do not have any further step to take.
