LLP incorporation related

  • Contents

Greetings!

I have a few doubts related to the incorporation of LLP. Can anyone please help me and clear my doubts? These are:

1) While filling FILLIP form, can partners self attest their identity/residence proof documents? (Or it has to be done by ca/cs/gazetted officer only?

2) Can a partner’s wife sign FILLIP form if she is a CA? (For example, Mr. A is a proposed designated partner and his wife is a CA. Mr. A and his mother are the only partners who are going to incorporate the LLP. So, can Mr. A’s wife sign FILLIP form as a professional?)

3) Can a proposed partner use his father’s house (let’s say first floor) to establish LLP’s registered office? (For example, Mr. A takes his father’s house, first floor on rent and use it as registered office of proposed LLP)

4) Suppose while filling FILLIP form one partner doesn’t have driving license/voter ID/passport, can that partner upload/attach his/her aadhar card as identity proof?

Thanking you in anticipation

1. It is better the documents be attested by a practising professional or a gazetted officer.

2. It is better that the other professional may sign. Signing by the wife may amount to related party.

3. Father's premises can be occupied. The rental agreement may be there.

4. If the said document is enumerated in the rules then it may be used.
