We are of the considered view that the appellant has made out a prima facie case as a decision of the Tribunal in the case of Solar Chemferts Pvt. Ltd. has been followed by this bench in the case of Shaifali Steels Ltd. vide order No. S/2175-2176/WZB/AHD/2012 dated 03.10.12. We do not find any reason to deviate from such a view already taken. .....
