..... #9679; Rule 86A is not a recovery provision but only a provision to secure the interest of revenue. ● If there is no positive credit balance in ECL, that order u/r 86A would be read to create a lien upto limit mentioned. As and when the credit entries arise, the lien would attach to those credit entries upto the limit set by the order. The ruling appears to be inconsistent with the whole schema of Rule 86A, which is to restrict ITC debit from the balance which is available in the ledger. M/S.
