The summary of order has been issued on 17.02.2022 i.e., within 5 days from the date of issue of show cause notice. The show cause notice issued is in violation of law and the principles of Natural Justice. Therefore the High Court held that the foundation of the proceeding in this case suffers from material irregularity and therefore not sustainable being contrary to Section 73(1) of the Act.
