In view of the above facts and settled legal position, we are of the opinion that the impugned assessment order passed under Section 144 read with Section 144B of the Act would not be tenable in absence of the show cause notice to the petitioner. Accordingly, the impugned order dated 23.4.2021 is hereby quashed and set aside and the matter is remanded back to the respondent Assessing Officer so as to enable the petitioner to give reply to the show cause notice to be served in accordance with law. Such exercise shall be completed within a period of 12 weeks from the date of receipt of the copy of this order. 10. The petition is accordingly allowed.
