Wockhardt Cephalosporin Facility Part of Corporate Debtor's Liquidation Estate Despite Alleged Sub-Letting.

The NCLAT determined that the Wockhardt Cephalosporin Facility, occupying 13,000 sq. ft. within a larger leased property, is part of the corporate debtor's liquidation estate. The corporate debtor had leasehold rights over the entire 64,925 sq. mtrs. area, acquired through agreements in 2017 and 2018. The MIDC did not approve sub-letting to Wockhardt Ltd., and the payment made by the appellant for unauthorized sub-letting charges was not deemed valid. Consequently, the appellant's request to exclude the 13,000 sq. ft. area from the corporate debtor's assets was denied, and the appeal was dismissed. .....
