2005 (11) TMI 314 - AT - Customs

The Appellate Tribunal CESTAT, Mumbai heard the case of Dr. Chittaranjan Satapathy represented by Shri Durgesh Nadkarni, Advocate. The appellant requested a waiver of pre-deposit due to financial hardship and goods abandonment. A penalty of Rs. 5 lakhs was imposed but argued as unjustified compared to co-noticee's penalty of Rs. 50,000. The Tribunal granted part waiver, directing the appellant to pre-deposit Rs. 50,000 within 6 weeks and report compliance by 10-1-2006. Compliance would result in the waiver of the remaining amount.
