1920 (1) TMI 1 - HC - Companies Law

The plaintiff appealed to restrain two arbitration proceedings regarding a contract for the sale of Hessian cloth. The contract stated that any dispute should be referred to arbitration under the Bengal Chamber of Commerce rules. The plaintiff had already received an award for one part of the claim but wanted to stop further arbitration. The High Court held that as each month's delivery was a separate contract, the defendant could proceed with arbitration for subsequent breaches. The appeal was dismissed, and costs were awarded.
