The Court concurred with the Board's decision that section 13(1)(d) would be applicable from the assessment year 1984-85. Consequently, the trust could not be denied exemption for the assessment year 1983-84. The Court answered the question in favor of the assessee, and no costs were awarded. Both judges agreed on the decision.
