2013 (11) TMI 1497 - SCH - Indian LawsRe transfer of employees - petitioners were appointed as Junior Engineers in the Irrigation Department - Due to non-availability of the posts, the petitioners became surplus and they were transferred to the Trade Tax Department - Petitioners again transferred to Irrigation department - Held that - order of re-transfer states that they will get seniority, regularisation and promotions on further posts in the parent Department. Their salary will also be protected - Therefore, no reason to interfere - Decided against petitioner.
The Supreme Court dismissed special leave petitions filed by Junior Engineers challenging their repatriation from Trade Tax Department to Irrigation Department in Uttar Pradesh. The Court noted that the engineers will receive seniority, regularisation, promotions, and protected salary upon transfer, thus finding no reason to interfere.
