Issue 1: Validity of reopening assessment under section 147(a) of the Income Tax Act
The case involved a reference under section 256(1) of the Income Tax Act, 1961, regarding the reopening of assessments for the years 1956-57, 1957-58, and 1958-59. The Income Tax Officer (ITO) initiated reassessment proceedings based on the belief that income had escaped assessment due to undisclosed sources. The assessee argued that all necessary facts were disclosed during the original assessment, and thus, the reassessment was not justified under section 147(a) of the Act.
