2023 (6) TMI 1201 - HC - CustomsAmendment of shipping bill - joint meeting had taken between the officers of the Customs Department and Director General of Foreign Trade and not only the issue regarding the petitioner therein has been resolved but the changes in the software system have been brought about - HELD THAT - The learned Counsel who appears for Respondent Nos. 1 and 2 states that the Customs Department has amended the shipping bill and the same is forwarded to the Director General of Foreign Trade (DGFT) and the necessary action will be taken by the DGFT. The learned Counsel for the Petitioner states that, in view of this development, the cause raised in this Petition stands redressed. The Writ Petition is accordingly disposed of.
Issues involved: Resolution of issues in O.S. Writ Petition No.3202 of 2022 regarding methodology, changes in software system, and examination of petitioner's claim in light of Advisory issued by Directorate General of Systems and Data Management.
Resolution of methodology and software system issues: On 14 March 2023, an order was passed in O.S. Writ Petition No.3202 of 2022, detailing the methodology to prevent recurring issues. A joint meeting between Customs Department officers and Director General of Foreign Trade resolved the petitioner's issue and implemented changes in the software system. The matter was placed "For Directions" on 13 March 2023, and the case was scheduled to be heard on 12 April 2023 along with the aforementioned petition. Examination of petitioner's claim based on Advisory: On 12 April 2023, the Court was informed about an Advisory issued by the Directorate General of Systems and Data Management on 11 April 2020. Respondents were directed to examine the petitioner's claim in light of this Advisory and inform the Court of their stance. The Customs Department amended the shipping bill, forwarded it to the DGFT, and assured necessary action. Consequently, the petitioner's cause was considered redressed, leading to the disposal of the Writ Petition.
