2024 (4) TMI 1259 - HC - Central Excise


The Allahabad High Court, through Hon'ble Justices Saumitra Dayal Singh and Donadi Ramesh, allowed the writ petition directing the release of fixed deposits seized from the petitioner and the company. The deposits in question were held under FDR Nos. 30202876167, 30202824977, and 30202752175, dated 10.07.2007, totaling over Rs. 1.77 crore. The Court noted that the Adjudication Order had been set aside by the Tribunal and affirmed by the Court in a related appeal (Central Excise Appeal No. 125 of 2019). Consequently, the Court held that "such goods and assets be released in favour of the petitioner forthwith along with statutory interest," granting the relief as consequential to the Tribunal's order.
