2003 (2) TMI 81 - HC - Central Excise

The High Court at Calcutta directed the Respondent-Department to regularize the appointments of Mr. Banerjee and Mr. Deb. The petitioner challenged an ex parte order requiring a deposit of Rs. 50 lakh, citing a Lawyers' Strike. The Court set aside the order, allowing a fresh hearing and imposing costs on the petitioner. The Court clarified it did not assess the merit of the dispute. The Respondents did not admit the allegations in the application. The Tribunal will schedule a new hearing if costs are paid within a week. Affidavit of Service is to be kept with the record. All parties must act on a signed copy of the Order.
