Nature of the Transaction: The second issue was whether the transaction was an adventure in the nature of trade or an investment. The Tribunal considered the surrounding circumstances, noting that only a small portion (1710 sq. yds.) of the total land (11400 sq. yds.) was sold shortly after purchase, while the remaining land was leased out on a long-term basis. The Tribunal upheld the CIT (A)'s order canceling the assessment of the AOP and deleting the additions in the individual assessments of Champalal Kothari and Kantilal Kothari.
