The High Court of Allahabad ruled that the assets assessed in the hands of Gajanand belonged to the Hindu undivided family constituted by Gajanand, his mother, and his wife. The court held that the property left by Rameshwar Das was owned by Gajanand as an individual and was subject to wealth-tax. The court referred to a similar case under the Income-tax Act and decided in favor of the assessee. The department was ordered to pay the costs of the assessee. Appeal dismissed.
