Therefore, the assessment was not deemed to be completed under section 23(1).

The interpretation of the order by the department differed from that of the assessee. The department viewed it as the income being below the exemption limit, while the assessee argued that the loss declared was correct, making the case not liable for assessment and tax recovery.

The court held that in the circumstances of the case, the interpretation favored by the assessee was correct. It concluded that the order on the return for the assessment year 1956-57 effectively computed the loss at Rs. 12,862, allowing the assessee to carry it forward to the subsequent assessment year 1957-58.

Therefore, the court answered the question by stating that the Income-tax Officer's order on the return for the assessment year 1956-57 should not be considered as an assessment under section 23(1) but as a computation of the loss for that year at Rs. 12,862.
