1992 (1) TMI 216 - HC - Central Excise

The Bombay High Court directed notices to be issued to Kumar Prabhulal Shah to show cause why he should not be prosecuted for forging documents and committing other offenses. Shah did not file any affidavit in response to the notices. The Court accepted the contention that prosecution in criminal court was sufficient and did not proceed under the Contempt of Courts Act. The show-cause notice was restricted to offenses mentioned in the judgment, and Shah was directed to be prosecuted for specific offenses under the Indian Penal Code. The show-cause notice regarding Contempt of Courts Act was discharged.
