After considering the arguments, the Tribunal found that the imported goods were described as Piston rings fitting equipment for mounting piston rings on pistons, indicating they were machines and mechanical appliances. The Tribunal agreed with the department that the equipment did not fall under the definition of tools for working in the hand under Chapter Heading 84.49. Therefore, the appropriate classification was under Chapter Heading 84.59. Regarding the specific classification under 84.59(1) or (2), the Tribunal determined that the equipment was not designed for production but for mounting piston rings, excluding it from 84.59(2) which covers machines for production of a commodity. As 84.59(1) is a residuary heading, the Tribunal held that the Piston rings fitting equipment is classifiable under Chapter Heading 84.59(1). Consequently, the impugned order was upheld, and the appeal was rejected.
