1996 (9) TMI 345 - AT - Customs

Issues: Classification of imported Stainless Steel Anchors under Heading 73.30 vs. Heading 73.33/40

Classification under Heading 73.30:
The appeal was against the order of Collector (Appeals) regarding the classification of Stainless Steel Anchors imported by the appellants. The appellants argued that the Anchors should be classified under Heading 73.30 as Anchors and parts thereof of iron and steel. They relied on Notification No. 38/84 and Notification No. 186/84 to support their classification.

Interpretation of Statutes and Common Parlance:
The Tribunal considered the common parlance understanding of the word 'Anchor' and its technical application in the present case. It was noted that the imported items were specialized for supporting refractory bricks in a pressure vessel, not in the traditional sense of ship anchors. The Tribunal emphasized interpreting the heading itself rather than relying on Chapter Notes, Section Notes, or Interpretative Rules. The technical material regarding the item's classification under Chapter 84 was not presented by the appellants, which could have influenced the classification decision.

CCC Explanatory Notes and Classification Criteria:
The Tribunal referred to the CCCN Explanatory Notes, which clarified that Heading 73.30 pertains to anchors for mooring ships and similar uses, excluding other types of anchors. The Tribunal highlighted that Heading 73.30 specifically covers anchors and grapnels of iron or steel, not stainless steel. The distinction between steel and stainless steel in various chapter entries supported the argument that Heading 73.30 does not encompass stainless steel articles.

Correct Classification and Decision:
In the absence of technical material supporting classification under Chapter 84 and considering the specific nature of the imported items, the Tribunal upheld the original assessment under Heading 73.33/40(2). The authorities were criticized for incorrectly treating the items as anchors for customs purposes, but the appellants' claim for classification under Heading 73.30 was rejected. The appeal was dismissed, affirming the Department's classification under Heading 73.33/40(2).

This detailed analysis of the judgment provides insights into the classification dispute regarding Stainless Steel Anchors and the Tribunal's reasoning for upholding the classification under a specific heading based on statutory interpretation, common parlance understanding, and international classification criteria.
