Summary

The Appellate Tribunal CEGAT, New Delhi, in the case of contravention of Notification 76/65, waived the penalty of Rs. 2,000 imposed on the appellant for possessing silver of Nepalese origin. The Tribunal found no evidence that the silver seized was exported to Nepal from countries other than India. The requirement of pre-deposit of penalty was waived and its recovery stayed during the appeal.
