The Appellate Tribunal CEGAT, New Delhi allowed the waiver of pre-deposit and stay of recovery for the Appellant, who had been declared a sick unit by the BIFR. The Tribunal considered the arguments from both sides and granted the stay petition unconditionally based on the Supreme Court judgments cited. The delay in filing the appeal was condoned.
