2000 (5) TMI 413 - AT - Central Excise

Issues: Non-appearance of parties, failure to comply with court orders, dismissal for non-prosecution

Paragraph 2: The case involved a history where the appellants were directed to deposit a specific amount within a set period due to lack of a strong prima facie case. Subsequently, the appellants filed a Writ Petition in the High Court against the Stay Order, which granted an interim stay while instructing the Tribunal to dispose of the appeal promptly.

Paragraph 3: Despite multiple directives and hearings, the appellants consistently failed to appear before the Tribunal or provide updates on the Writ Petition progress. The High Court's order for a quick disposal of the appeal within eight weeks remained unfulfilled due to the appellants' non-cooperation and absence during proceedings.

Paragraph 4: After more than two years of inaction and non-appearance by the appellants, the Tribunal noted their lack of interest in progressing the appeal. Despite clear warnings and instructions, the appellants continued to be absent, leading to the dismissal of the appeal for non-prosecution due to their persistent non-cooperation and failure to comply with court orders.
