Summary

The Appellate Tribunal CEGAT, Calcutta ruled in favor of the appellant, dispensing with the pre-deposit condition of penalty amount of Rs. 1.00 lakh imposed on the owner of a truck carrying contraband synthetic fabric covered with bananas. The owner claimed lack of knowledge about the fabric being contraband. The appellant had already paid Rs. 5,000.00 towards the penalty. The truck was confiscated with an option to redeem it for Rs. 50,000.00. The Tribunal dispensed with the pre-deposit condition of Rs. 95,000.00 and scheduled the main appeal for 24-10-2000.
