2001 (5) TMI 389 - AT - Customs

The Appellate Tribunal CEGAT, Kolkata overturned the decision to confiscate Rs. 63,000 and impose a penalty of Rs. 10,000 on the appellant for allegedly importing Indian currency from Bangladesh. The tribunal found no evidence supporting the claim and ruled in favor of the appellant, stating that proximity to the border alone is not conclusive proof of currency importation. The appeal was allowed with consequential relief granted to the appellant.
