Rule 5 - Conditions for registration - Intellectual Property Rights (Imported Goods) Enforcement Rules, 2007Extract 5.Conditions for registration. - The grant of registration under rule 4 shall be subject to following conditions, namely: - (a) the right holder or his authorised representative shall execute a bond with the 1 [Principal Commissioner of Customs or Commissioner of Customs, as the case may be] for such amount with such surety and security as deemed appropriate by the 1 [Principal Commissioner or Commissioner as the case may be], undertaking to protect the importer, consignee and the owner of the goods and the competent authoritiesagainst all liabilities and to bear the costs towards destruction, demurrage and detention charges incurred till the time of destruction or disposal, as the case may be; (b) the right holder shall execute an indemnity bond with the 1 [Principal Commissioner of Customs or Commissioner of Customs, as the case may be] indemnifying the Customs authorities against all liabilities and expenses on account of suspension of the release of allegedly infringing goods. 2 [ (c) the right holder or his authorised representative shall inform the Commissioner of Customs at the time of giving notice about any amendment, cancellation, suspension, or revocation of the Intellectual Property Right by the authorities under the Intellectual Property Laws or any Court of Law or Appellate Board, subsequent to its registration with the authorities under the Intellectual Property Law and in case of any such amendment, cancellation, suspension or revocation of the Intellectual Property Right during the validity of the notice registered under rule 4, the same shall be brought to the notice of the Commissioner of Customs by the right holder within a period of one month of the date of communication of any such amendment, cancellation, suspension or revocation of the Intellectual Property Right to the right holder or any person authorised by him in this regard; (d) in the event of any amendment, cancellation, suspension or revocation of the Intellectual Property Right by the authorities under the Intellectual Property Law or by any Court of Law or Appellate Board, the Commissioner of Customs may accordingly amend, suspend or cancel the notice and the corresponding protection. ] ---------------- Notes:- 1.
