CHAPTER VI MISCELLANEOUS Liability for non-compliance of obligations. 25. Without prejudice to any action under any law for the time being in force, (a) any intermediary who fails to comply with any of the obligations while execution of warrant of authority, shall be liable for any one or more of the following actions: i. adjudication under section 15HB of the Act; ii. proceedings under Chapter V of the Securities and Exchange Board of India (Intermediaries) Regulations, 2008; iii. prosecution under section 24 of the Act; (b) any person other than an intermediary who fails to comply with any of the obligations while execution of warrant of authority, shall be liable for any one or more of the following actions: i. adjudication under section 15HB of the Act; ii. action under section 11B and sub-section (4) of section 11 of the Act; iii. prosecution under section 24 of the Act.
