Analysis:

1. The petitioner sought a writ to quash the impugned letters dated 12-9-2011 and 29-6-2011 issued by the respondents. The petitioner had entered into a slump sale agreement with another company to take over its business as a going concern. The court, considering the facts and the circular issued by the Central Board of Excise and Customs, concluded that if the petitioner had already exercised the option in writing to avail the exemption before the first clearance, as required, then the petitioner would be entitled to the exemption. Consequently, the court allowed the writ petition in favor of the petitioner.
