Issues involved: Delayed response to RTI application, treatment of information as third party, denial of inspection, non-provision of information

The judgment by the Central Information Commission, New Delhi addressed several issues arising from an RTI application filed by Shri R.K. Jain. The appellant sought certified copies of orders for priority hearing, all orders passed by the Commission, and inspection of files related to specific appeals/complaints. The appellant was dissatisfied with the delayed response and treatment of information as third party by the CPIO, Shri K.L. Das. The Commission agreed with the appellant's contention, directing the Nodal CPIO to circulate the correct procedure to all CPIOs for future guidance.

Another issue highlighted in the judgment was the denial of inspection by Shri Mohapatra, CPIO, for files related to specific appeals/complaints. Despite the files being available, inspection was not allowed. The Commission directed the CPIO in charge of the relevant registry to provide inspection to the appellant within 15 working days from the date of the order.

Furthermore, the judgment addressed the non-provision of information regarding certain appeals/complaints against the former CIC(SM) registry. Shri Vijay Bhalla, CPIO, was directed to furnish the required information within 15 working days from the receipt of the order. The appeal was disposed of, and the appellant was informed of the option to appeal further under section 19(3) of the RTI Act, 2005, if desired.

In conclusion, the judgment by the Central Information Commission, New Delhi, emphasized the importance of timely responses to RTI applications, correct treatment of information, and the provision of access to requested files for inspection.
