2020 (9) TMI 500 - SCH - GSTTransfer petition from National Anti-Profiteering Authority (NAA) - request for transfer of the writ petitions pending in the High Courts of Bombay, Gujarat and Karnataka, to the Delhi High Court - constitutional validity of Section 171 of CGST Act, 2017 - HELD THAT - Let notice, returnable within two weeks, be issued through all permissible modes.
The Supreme Court transferred writ petitions challenging the constitutional validity of Section 171 of CGST Act, 2017 to the Delhi High Court. The National Anti-Profiteering Authority filed a Transfer Petition for this purpose. Around 40 similar writ petitions are being heard by the Delhi High Court. The Court's order dated 19.02.2020 transferred similar writ petitions from other High Courts to Delhi High Court as well. Notice to be issued within two weeks through all permissible modes, and the petitioner must ensure service on the respondent-writ petitioners in the meantime.
