Time-limit for completion of all pending penalty proceedings under the 1922 - Income Tax - 571/CBDT

INSTRUCTION NO. 571/CBDT Dated : July 17, 1973 Attention is invited to para 3 of the Board's letter No.7/12/68-IT(Audit) dated 16.1.1969, the Commissioners of Income-tax were requested to prescribe a time-limit for completion of all pending penalty proceedings under the 1922 Act, and to watch their progress through a monthly statement. It appears that in spite of these instructions, quite a large number of penalty proceedings are still pending in the various Commissioners' charges. The Public Accounts Committee have, in their 87th Report presented recently to the Lok Sabha, adversely commented on this large pendency and have directed that all these pending proceedings should be completed within this year. The Board desire that the Commissioners should bestow their personal attention to this aspect of work and ensure that no such penalty proceeding is kept pending beyond 31.3.1974 unless stayed by the Judicial authorities. 2. In order to comply with the directions of the P.A.C. a quarterly report on the pending penalty proceedings under 1922 Act, in the following proforma may please be sent to the Board so as to reach the Board positively on 15.8.1973, 10.10.73, 10.1.74 and 10.4.74.
